Gervais Social Media Complaint
Dear Gervais Community Members,
On Thursday, March 30, 2023, the Gervais School District filed a lawsuit against several social media giants. The body of the complaint is attached and posted on the school district’s website.
In the last year, many of us have observed employees or former employees of various social media platforms testify before Congress subcommittees on how teens are targeted by these platforms using very sophisticated algorithms designed to constantly engage and even provoke our youth. Even prior to the pandemic the district was dealing with issues which started on social media and ended up in the buildings. This included situations such as students engaging in destructive or vandalism challenges aimed at district property, targeting of teachers and fellow students with follow-up posts meant to shame and cyberbully individuals. Additionally, because of the extent and often extreme bullying, the district has seen an increase in the mental health issues of students in relation to body image, social standing, self-esteem, and friend groups to name a few. This requires significant time by counselors, teachers and administrators to address these situations which include working with parents on situations they are often not aware are occurring. Dealing with these issues takes time and financial resources away from the general operations of our buildings. When the district was approached about being a part of this litigation by attorneys Keller Rohrback LLP based in Seattle, the district felt it had the documentation and evidence to support that social media companies do, in fact, cause harm to students.
The district has two goals in mind with this lawsuit. The first is that we want social media platforms to make changes in how they design their programs and platforms so that the negative targeting of our youth, which often results in mental health and safety issues, stops. It is a constant barrage on our youth that is difficult for them to navigate in a healthy way. The other goal is that the district is seeking to bridge the gap between the resources we are having to use and the budget we have available. Dealing with these issues requires significant time from teachers, counselors and administrators that were not created by the district but definitely impact our ability to educate students.
At the same time, the district promotes positive and appropriate use of social media platforms and provides education to students on what those behaviors look like in lessons delivered by teachers or counselors at all grade levels. Helping students navigate the tools available to them and assisting parents in protecting students so they are able to learn are important roles for a district.
• This complaint does not require any funds from the district and, should the companies lose the lawsuit or decide it is in their best interests to settle, the attorneys are paid out of those monies and the remainder is awarded to the district. Should the district receive any monies, those will go into staffing supports and educational opportunities for our students. The district will seek input on these spending priorities should monies become available.

Cuando los abogados Keller Rohrback LLP con sede en Seattle se acercaron al distrito para que participara en este litigio, el distrito sintió que tenÃa la documentación y la evidencia para respaldar que, de hecho, las empresas de redes sociales causan daño a los estudiantes.
El distrito tiene dos objetivos en mente con esta demanda. La primera es que queremos que las plataformas de redes sociales realicen cambios en la forma en que diseñan sus programas y plataformas para que se detenga la focalización negativa en nuestra juventud, que a menudo resulta en problemas de seguridad y salud mental. Es un bombardeo constante sobre nuestra juventud que les resulta difÃcil navegar de manera saludable. El otro objetivo es que el distrito busque cerrar la brecha entre los recursos que tenemos que usar y el presupuesto que tenemos disponible. Lidiar con estos problemas requiere un tiempo significativo de parte de los maestros, consejeros y administradores que no fueron creados por el distrito pero que definitivamente impactan nuestra capacidad para educar a los estudiantes.
Al mismo tiempo, el distrito promueve el uso positivo y apropiado de las plataformas de redes sociales y brinda educación a los estudiantes sobre cómo se ven esos comportamientos en lecciones impartidas por maestros o consejeros en todos los niveles de grado. Ayudar a los estudiantes a navegar por las herramientas disponibles para ellos y ayudar a los padres a proteger a los estudiantes para que puedan aprender son roles importantes para un distrito.
• Esta demanda no requiere fondos del distrito y si las empresas pierden la demanda o deciden que es lo mejor para sus intereses llegar a un acuerdo, se paga a los abogados con ese dinero y el resto se otorga al distrito. Si el distrito recibe algún dinero, se destinará a apoyos de personal y oportunidades educativas para nuestros estudiantes. El distrito buscará información sobre estas prioridades de gasto en caso de que haya dinero disponible.
